How do I explain the Safe Harbor to a patient?
- Nothing is free
- A discount will be applied BEFORE insurance is billed
- The patient understands their copay is still followed, but it is AFTER the discount is applied.
Sample Script:
“Mrs. Johnson, we’d like to offer a discount on your care. In order to legally do so, we need to register your name and email address with our discount program service. Registration means you understand nothing is free, a discount will be applied BEFORE insurance is billed, and your copay is still followed, but it is AFTER the discount is applied.”
Does a patient need to validate their coupon (accept the Safe Harbor) each visit where I am providing a discount?
No, a patient only needs to validate (accept the Safe Harbor) one time on the day the first discount is applied.
Does each family member need to validate (accept the Safe Harbor)?
No, only the family member considered the primary insured on the health plan needs to validate (accept the Safe Harbor). Discounts may then be applied to all family members covered by that plan.
My patient does not have an email address. What should be entered for their Safe Harbor registration?
In the instance a patient does not have an email address, you may use a general practice email address as long as the patient’s first and last name are entered.
Do not automatically use a practice email address for every registration; only in the instances where a patient doesn’t have email. The only purpose of using an email address is as a unique identifier. Patients are never emailed anything from the coupon program site.
Is there a paper version of the Safe Harbor my patient may sign?
No, there is not a paper version of the Safe Harbor (terms of acceptance) to use. The acceptance must be electronic through the site so it records on our server as the official record of acceptance.
We recommend you implement this by having you or your staff enter the registration versus relying on the patient to actually register.

What if my staff (or patient) does not remember validating on the Safe Harbor page?
Please have them validate (accept the Safe Harbor) the patient again – it is perfectly fine for a person to have more than one entry on your registration log.
Our office receives emails that we have a new coupon registration but nothing else. What is this?
This is merely a notification that a registration has been submitted via your Safe Harbor link and the information has been recorded in the log for your practice.
The actual registration log is not something you have access to. Patient registrations are recorded however the terms of the program do not allow us to send you or provide access to the registration log.
Coupon program users who want to keep track of which patients they have registered for a discount have implemented their own tracking system – whether it’s a color coded mark on the patient file, note in their EHR system, etc., (it’s also why we recommend patient registration be completed as part of front desk check-in/check-out procedures versus leaving the patient to register themselves on a device such as a tablet).
Do “paper” coupons need to exist as a hard copy in the patient's file?
No, paper coupons do not need to exist as a hard copy in their file. You do not need to use the set of PDF coupons provided with your program set up if you don’t want to. The PDF coupon set is included as courtesy for those clients who want to utilize them as handouts at prospective patient events.
Can I discount however I want once the patient accepts the Safe Harbor?
No, you must adhere to the Terms of Use, bill discounts correctly per your one-on-one training session and the supporting training videos, and NOT exceed the 60% maximum discount parameter.
How do I make changes to the coupon or information posted to my profile page?
Users do not have editing rights to their Safe Harbor or Coupon profile pages.
The coupon posted to your profile page (what you see after completing a patient registration) is the default posting placed on every client’s profile page. This posting doesn’t restrict you to only providing 10% discounts. Our recommendation is you leave the default posting.
But if you prefer something different, let us know what that is – the request will be reviewed for compliance purposes and, if allowed, your profile page will be updated. If not allowed, you will be contacted by our team to review the rules and find a workable solution.
Should I be sending the Letter to Insurance with my claim submissions?
No, you do not submit the Letter to Insurance unless a carrier questions why a discount was given. If this happens, please contact us so we can provide you with the patient’s recorded, date-stamped acceptance of the Safe Harbor to send along with the letter.
Does using Compliant Coupons create a dual fee schedule?
The simple answer is “yes”, BUT the OIG has stated there are limited exceptions that are allowed. One of the ways this is met is when a “Safe Harbor” is accepted. Only when the patient accepts the “Safe Harbor” by registering via the URL link we provide your practice is having multiple different fees allowed.
When using a coupon, should the "-52" modifier be used since the insurance company is billed less than our usual fees?
No, this is not applicable. The “-52” modifier is to show a service is reduced because you performed less than 15 minutes.
